7. PRIVACY AND DATA PROTECTION
7.1. Compliance with Data Protection Laws
Leadport processes user data in accordance with its Privacy Policy and all applicable data protection laws, including but not limited to GDPR and CCPA. Users acknowledge and agree to comply with the data protection terms outlined in the policies of Leadport and its third-party service providers, including:
7.2. User Responsibilities in Data Processing
The User acknowledges that it shall be solely responsible for obtaining all necessary consents from its customers and prospective customers regarding the collection, processing, and sharing of their personal data. Leadport acts solely as an intermediary platform and has no direct interaction with the User’s customers or prospective customers. Therefore, it is the User’s responsibility to fulfill all data protection obligations, including but not limited to:
- Providing required privacy notices and obtaining explicit consent when necessary,
- Ensuring compliance with commercial electronic communication regulations,
- Ensuring that employees and business partners comply with applicable data protection regulations.
7.3. Data Processing by Leadport
Leadport processes and stores various types of user data, including user account details, customer interaction records, and service usage logs. The User acknowledges that Leadport may process personal data through automated or non-automated means, including but not limited to:
- Collection, recording, storage, retention, modification, reorganization, disclosure, classification, and restriction of use.
7.4. Data Security and Breach Notification
Both Parties agree to take all necessary technical and administrative measures to prevent the unlawful processing, unauthorized access, and misuse of personal data. If either Party suspects or becomes aware of a data breach, it shall immediately notify the other Party in writing and take all necessary preventive measures.
7.5. User Rights and Data Requests
Users have the right to request access, correction, or deletion of their personal data under applicable privacy laws, including GDPR and CCPA. To exercise these rights, users may contact privacy@leadport.ai.
7.6. Data Retention and Deletion
Upon the User’s written request, Leadport shall securely delete or return all copies of any personal data it holds related to the services provided under this Agreement in a permanent and secure manner.
7.7. Indemnification for Data Breaches
If either Party, its employees, or subcontractors violate the data protection obligations outlined in this Agreement, resulting in damages to the other Party, the breaching Party shall be fully liable for any direct or indirect losses, including regulatory fines, compensation claims, and reputational damages.
7.8. Continued Validity
The obligations outlined in this Privacy and Data Protection section shall remain in effect indefinitely, regardless of the expiration or termination of this Agreement.
13. OTHER SERVICES OFFERED BY LEADPORT
- May only be used for normal business use.
- Are provided only for live dialog between two individuals.
- May not be used for any of the following prohibited uses:
- Trunking or forwarding your Leadport number to another phone number(s) capable of handling multiple simultaneous calls, or to a private branch exchange (PBX) or a key system.
- Auto-dialing or “predictive” dialing (i.e., non-manual dialing or using a software program or other means to continuously dial or place outbound calls).
- (Purchased package of lead amount) *(5 voice minutes/month) in Leadport Pricing Plans
- To violate any law, regulation, or other published policy;
- To violate or infringe on intellectual property, privacy, or rights of another;
- To violate any agreement, rules, or policies that govern the use of your mobile device;
- To transmit any content that is illegal, abusive, harassing, racist, hateful, or objectionable;
- To transmit sexually explicit, pornographic, obscene, or objectionable content;
- To sell, trade, resell, or exploit for any unauthorized commercial purpose or transfer any Leadport account;
- To stalk, harass, or harm another individual;
- To impersonate another, misrepresent, or falsely identify yourself;
- To violate any applicable third-party policies or requirements that Leadport has communicated to you;
- To engage in fraudulent activity, bypass phone identification systems, or spam users with unsolicited advertising;
- To interfere with Leadport’s Service using unauthorized devices or software.
